In response, Texas Children’s Hospital publicly claimed it would suspend all such services for minors.
Behind closed doors, however, the hospital’s own internal records told a different story. Dr. Eithan Haim, working within the TCH system during his surgical training, witnessed firsthand what he later described as a betrayal of the public trust and a violation of the state’s legal and ethical standards. Despite public declarations, the hospital had resumed gender transition services—offering hormone therapy and surgical preparation for minors, some as young as 11.
In early 2023, Dr. Haim confirmed this continued activity by accessing hospital documentation. According to his account, all patient-identifying information was redacted. The goal was not to expose individuals, but to shed light on an institutional practice that had resumed quietly despite being clearly contrary to state policy and public statements.

Though most hospital employees remained silent due to fear of retaliation, multiple anonymous staffers reportedly corroborated Dr. Haim’s claims to journalists and congressional staffers, validating that gender-transition procedures were continuing under euphemistic terms like “adolescent development services.”
The DOJ Comes Knocking: Biden Administration Retaliation
Rather than investigate the hospital’s conduct, the Biden Administration took aim at Dr. Haim. On June 17, 2024, Dr. Haim was indicted by a federal grand jury on four counts of wrongfully obtaining and disclosing protected health information. The DOJ accused him of violating the Health Insurance Portability and Accountability Act (HIPAA), alleging that he accessed patient data without authorization and with malicious intent.
Federal prosecutors claimed he posed a risk to patient privacy—even though the documents he supplied were redacted and no patient identities were ever released. The indictment notably followed a series of public statements by President Biden and HHS Secretary Xavier Becerra affirming that so-called gender-affirming care was “essential healthcare.”
To many observers on the Right, this was more than a legal dispute—it was political targeting. Senator Ted Cruz condemned the indictment as “a disgraceful misuse of federal power to protect a progressive medical agenda at the expense of transparency.” Senator Josh Hawley echoed that sentiment, calling the charges “a blatant attempt to criminalize whistleblowing and silence truth-tellers.”
Adding to the scandal, Assistant U.S. Attorney Tina Ansari—originally assigned to the case—was quietly removed after it was revealed that close family members had significant ties to Texas Children’s Hospital, including financial and board involvement. The DOJ never disclosed this conflict of interest until it became public through congressional inquiry.
Vindication: The Trump DOJ Drops the Case
When Donald J. Trump returned to office in January 2025, his administration swiftly reviewed controversial prosecutions initiated under Biden. On January 24, the Department of Justice dismissed all charges against Dr. Haim “with prejudice”—meaning he cannot be prosecuted again for the same alleged conduct.
In a short but pointed statement, Attorney General Jeffrey Clark noted, “The Department of Justice under President Trump is committed to protecting whistleblowers, especially when their actions expose misconduct in sensitive institutions entrusted with the care of children.”
Dr. Haim responded with measured relief. “I’m grateful to be free, but this was never about me. It’s about the children who have no voice and no ability to escape the ideological capture of the institutions meant to protect them. We must not allow politics to silence truth when children’s lives are on the line.”
A Hero for the Children: The Legacy of Dr. Eithan Haim
Dr. Haim’s stand came at a steep cost. He faced public smearing, legal harassment, and the threat of prison—all because he chose to honor his conscience. His actions have inspired not only parents and conservative lawmakers but also a growing number of medical professionals who are beginning to speak out against what they see as the politicization of pediatric medicine. Bills are now pending in several states that would restrict gender-transition procedures on minors, often citing Dr. Haim’s revelations as part of the justification.
In a time when “affirmation” is often code for irreversible alteration, Dr. Eithan Haim affirmed something far more enduring: the integrity of medical ethics, the innocence of childhood, and the courage to speak truth even when the powerful come knocking.
